Essential clauses every creator contract should include
1. Scope of Work
- Number and type of deliverables (video, post, story, reel...)
- Specific platforms (TikTok, Instagram, YouTube...)
- Completion timeline and posting schedule
- Requirements for length, format, and tone
2. Content Ownership
- Does the creator retain copyright, or does the brand acquire full ownership?
- Can the brand repurpose content for ads?
- What is the usage term?
- Can the content be edited after delivery?
3. Payment Terms
- Total contract value
- Payment schedule: deposit percentage, final payment timing
- Accepted payment methods
- Final payment trigger: after posting or after approval?
4. Revision Rights
- How many free revisions are included?
- How long does the brand have to review and provide feedback?
- What happens if both parties disagree on changes?
Sample contract language
Ownership: Creator retains copyright over all content produced under this agreement. Brand is granted a non-exclusive license to use the content for [X] months from the posting date, for the following purposes: [list specifically]. Any use beyond this scope requires a separate written agreement.
Payment: Total contract value: [amount]. Deposit of [X]% upon signing. Remaining balance due within [X] business days after content is approved and published.
Revisions: Brand may request up to [X] rounds of revisions within [X] days of receiving the draft. Revisions beyond this limit will be billed at [X] per round.
Tips for using this template
- Include full legal names and contact details of both parties
- Include signing date and signatures from both parties
- For high-value contracts (over 20M VND), consider notarization
- Keep copies of the signed contract in at least two separate locations
